We appreciate you using bingoor.

For your information, "AUAXI AID" (henceforth referred to as "We," " bingoor," "Us," and "Our") is a company that was incorporated under the Companies Act, 2013 and has its registered office at First floor ,35 A, Shyam nagar 3rd, mangalam ananda road , Jaipur, Rajasthan -302029.

The following are the terms and conditions/terms of use ("Terms") that apply to the Services (described later) and the bingoor Platform (defined later):

Acceptance of the conditions

These Terms are meant to inform you of your legal rights and obligations regarding your use of bingoor is website, www. bingoor.com ("Site"), and/or any associated software or mobile applications (collectively referred to as the " bingoor Platform"), including but not limited to the services that bingoor provides through the bingoor Platform or in any other way ("Services").
These Terms and bingoor Privacy Policy, which can be found at https:// bingoor.com/privacy ("Privacy Policy"), will govern how you use and access the bingoor Platform. You acknowledge that this constitutes an agreement between you and bingoor and agree to be bound by the Terms, including any additional terms and conditions and policies mentioned herein and/or accessible by hyperlink on the bingoor Platform, by using the bingoor Platform and/or engaging in any sale-purchase transaction. If you disagree with the Terms or cannot be bound by the Terms/Privacy Policy, you may not be able to utilise the Services or access the bingoor Platform.
bingoor reserves the right to change these terms at any moment without prior notice. Therefore, every time you use and/or use the bingoor Platform, it is highly advised that you reread these Terms as they are available on the bingoor Platform. These Terms will take precedence over any other terms of use that may be found on the bingoor Platform in the case of a disagreement or inconsistency.
The people who visit, access, view, browse, and/or utilize the bingoor Platform at any time are referred to as "visitor(s)," "user(s)," "you," "your," and "customer(s)" herein.

Overview of Services

The bingoor Platform facilitates transactions between buyers and sellers who offer goods and services for purchase or supply. bingoor, its affiliates, and third parties (referred to as "Third Party Sellers") may list or offer goods and services for sale or supply on the bingoor Platform (these third-party goods and services will henceforth be referred to as "Third Party Offerings"). To be clear, in terms of the Third Party Offerings, bingoor does not offer customers any services other than the bingoor Platform, which they can use to transact at their own expense and risk, and any other services that may be expressly disclosed in writing. Only a few Indian regions are able to access services on the bingoor Platform.
bingoor has no control or influence over the Third Party Offerings and is not and cannot be a party to any transaction between you and the Third Party Sellers (which will be a bipartite agreement between you and the Third Party Seller). bingoor does not support or endorse the sale, supply, or purchase of any such products or services on the bingoor Platform, nor does it make any representations or warranties regarding the Third Party Offerings, including those pertaining to quality, suitability, merchantability, and fitness for any purpose. As a result, bingoor disclaims all obligations and warranties related to any Third Party Offerings on the bingoor Platform.

Suitability

The bingoor Platform is not accessible to anyone who is "incompetent to contract" as defined by the Indian Contract Act, 1872, including minors and undischarged insolvents. You may, however, use or access the bingoor Platform under the supervision of an adult parent or legal guardian who is "competent to contract" and consents to be bound by these terms if you are a minor, that is, under the age of eighteen. However, you are not allowed to buy any goods (including tobacco products) that is intended for adult use or whose sale to minors is forbidden, even if you are under supervision.
The bingoor Platform is designed to serve as a platform for end users who want to buy products or services for domestic or self-consumption. You cannot utilise the bingoor Platform if you are a retailer, institution, wholesaler, or any other business-to-business user.
bingoor uses algorithms and/or pre-determined criteria-based technologies, among other things, to determine compliance with eligibility criteria. As a result, your usage may occasionally be restricted or blocked due to overlap with these algorithms and pre-determined criteria. If you are a legitimate user of the bingoor Platform in such circumstances, please get in touch with us for assistance.
You attest that you are authorised to accept these terms on behalf of any person or business you are using the bingoor Platform on. Additionally, you and such person/entity agree to indemnify us for any violations of these terms and to be jointly and severally accountable for compliance.

Account and Registration Requirements

To place orders on the bingoor Platform, all users must register and log in. For all correspondence pertaining to your purchases from the bingoor Platform, you must maintain your account and registration information up to date and accurate. By accepting the Terms, you consent to receive newsletters and promotional, transactional, and other messages from bingoor and its affiliates and group companies. By using the opt-out options provided in such messages, you can choose not to receive such communications and/or newsletters. Additionally, you can modify your notification options in the bingoor Platform's profile section.
When you visit and utilise the bingoor Platform, bingoor may gather your personally identifiable information, such as your name, email address, age, address, mobile phone number, and other contact details; demographic profile (such as your age, gender, occupation, education, address, etc.); preferences; and details about the pages you visit or access on the bingoor Platform, the links you click on the bingoor Platform, and the frequency with which you access a specific page or feature. In order to run the bingoor Platform and offer you with services, we may also gather information about the transactions you make on it, including financial data. bingoor privacy policy will apply to any personally identifiable information that is gathered.
By registering your mobile number with us, you give us permission to contact you via phone calls, SMS notifications, mobile applications, and/or any other electronic means of communication in the event of an order, shipment, delivery, customer support-related updates, or for any other correspondence that may be necessary in the course of providing our services.

Restricted Access & License

Bingoor offers you a personal, limited, non-exclusive, non-transferable, and revocable license to access (for personal use only) the Bingoor Platform and use the Services, subject to the terms outlined in these Terms, only as specifically allowed in these Terms in a lawful manner. With the exception of page caching, you are not allowed to download or alter any part of it without Bingoor is express prior written approval. Any resale or commercial use of the Bingoor Platform or its contents, any collection, use, or derivative use of the Bingoor Platform, its contents, any product listings, descriptions, or prices, any downloading or copying of information for the benefit of another third party, and any use of data mining, robots, or comparable data gathering and extraction tools are all prohibited by this limited license.

You hereby agree and undertake not to use, create, host, display, upload, modify, publish, transmit, update, or share any information, content, comments, message, language, document, or synthetically generated information (including in relation to gifting services, printing services, orders to be delivered to third parties, or messages to be delivered along with the order) (whether in writing or otherwise) while communicating on the Bingoor Platform, including but not limited to communicating with our support agents, delivery partners, or service providers, through any medium, which ("Prohibited Content":
are not abiding by these terms.
belongs to someone else and over which you have neither complete nor any rights;
is harmful, threatening, abusive, including content that depicts child sexual abuse; indecent, discriminatory, tortious, vulgar, profane, harassing, blasphemous, defamatory, problematic, obscene, pornographic, paedophilic, libelous, invasive of another's privacy; non-consensual intimate imagery; hateful, or racially or ethnically objectionable; disparaging; related to or encouraging money laundering or gambling; or in any other way offensive, objectionable, menacing, inappropriate, or illegal;
includes content that is in violation of the Services' standards;
accuses others of breaking the law or talks about physical altercations;
attempts to mimic another person or thing and/or presents a real person or event in a way that is likely to mislead others about their identity, behavior, or comments;
disguises or attempts to conceal the source of your messages or content, such as by: (a) submitting your content under a fake name or false pretenses; or (b) concealing or attempting to conceal the IP address from which your content is submitted;
harms children in any kind;
violates any copyright, patent, trademark, or other proprietary or intellectual property rights;
violates any applicable law, such as the Protection of Children from Sexual Offences Act of 2012 or the Bharatiya Nyaya Sanhita of 2023, and may be subject to civil or criminal penalties;
includes any computer code, files, or programs intended to disrupt, destroy, or restrict the functionality of any computer resource, including software viruses;
endangers public order, friendly relations with other countries, India's unity, integrity, defence, security, or sovereignty; incites the commission of any crime that can be prosecuted; obstructs the investigation of any crime; or insults another country;
is deceptive or known to be untrue in any manner; and/or
is a review that is fraudulent or intentionally false;
creates or results in a conflict of interest or is a type of deceitful advertisement;
is commercial in character and includes, but is not limited to, spam, surveys, competitions, pyramid schemes, postings or reviews that are removed or submitted in exchange for money, postings or reviews that are withdrawn or submitted by the company being reviewed, or other advertising materials.
claims or suggests that we are sponsoring or endorsing comments in any form;
interferes with, interferes with, or destroys any feature of the services or the servers or networks that are connected to the services;
hacks or gains unauthorised access to our private or proprietary data, as well as the data of another user or users;
 violates any fiduciary relationship or contract (for instance, by revealing secret or proprietary information of your client or employer in violation of a non-disclosure, employment, or consulting agreement););
disassembles, decompiles, reverse engineers, or makes other efforts to extract source code from the Services;
eliminates, evades, disables, damages, or otherwise interferes with security-related features or features that impose usage restrictions on the Services;
violates the limitations included in any robot exclusion headers on the Services, if applicable, or gets around other restrictions put in place to restrict or prohibit access to the Services;
gathers, divulges, accesses, or retains personal data about others clients of the services;
is published by a bot;
leads to the production of a fraudulent document or electronic record;
attempts to do any of the aforementioned tasks.
You understand that Bingoor is under no duty to review or modify any material or to keep an eye out for violations of the Terms in your or anyone else's access to or use of the Services. However, we have the right to do so in order to run and enhance the Services (including, but not limited to, fraud prevention, risk assessment, investigation, and customer support purposes), to make sure you abide by the Terms, and to comply with any applicable laws, court orders, consent decrees, administrative agencies, or other governmental bodies.
You, and not Bingoor, are solely and exclusively responsible for any and all liabilities resulting from or pertaining to breach of these Terms, including in respect to the aforementioned information, content, or message.
Without Bingoor's express prior written approval, neither the Bingoor Platform nor any part of it may be replicated, copied, sold, resold, visited, or otherwise used for any commercial purpose.
Without Bingoor's express prior written authorisation, you are not permitted to frame or use framing methods to enclose any trademark, logo, or other private information (such as images, text, page layout, or form) of the Bingoor Platform, Bingoor, and/or its group companies/affiliates.
Without Bingoor's express prior written approval, you are not permitted to utilise any meta tags or other "hidden text" that uses Bingoor's name or trademarks.
You are prohibited from attempting to use hacking, "password mining," or any other illegal method to obtain unauthorised access to any part or feature of the Bingoor Platform, any other systems or networks connected to the Bingoor Platform, any server, computer, network, or any of the services provided on or through the Bingoor Platform.
Any unauthorised usage will automatically end the license or authorisation that Bingoor has provided, at its sole discretion.

Advertising

A portion of the website may include promotional content, advertising information, or other content that customers or other parties (including brands) have provided to Bingoor. It is solely the responsibility of the party supplying the information or content to ensure that it complies with applicable national and international law before it is included on the Bingoor Platform. The terms, conditions, warranties, and representations pertaining to any correspondence, business dealings, or participation in promotions of advertisers (other than Bingoor) found on or through the Bingoor Platform, including payment and delivery of related goods or services, are exclusively between you and such advertisers. Any error, omission, or inaccuracy in advertising material, as well as any loss or damage of any kind resulting from such transactions or from the existence of such other advertizer or advertisers on the Bingoor Platform, will not be the responsibility or liability of Bingoor.

Bingoor is not involved in any way in the collection or use of funds collected in accordance with a charitable campaign ("Charitable Campaign") for any information sent to customers and/or displayed on the Bingoor Platform where customers have the option to donate money by (a) payment on a third-party website or (b) depositing funds to a third-party bank account. Bingoor functions solely as a technological platform that facilitates the collecting of donations on behalf of the charity organization for philanthropic campaigns where clients have the opportunity to give via the Bingoor Platform. With the exception of serving as a facilitator, Bingoor is not involved in any way in the collection or use of donations obtained in connection with any charitable campaign. Regarding the truth, completeness, legality, or dependability of any information pertaining to the Charitable Campaign, Bingoor disclaims all responsibilities. Customers are recommended to conduct an independent verification, including accepting the terms and conditions of the relevant charitable organization, before taking any action in this respect. Information about the Charitable Campaign is displayed solely for informational purposes. Such contributions are entirely voluntary. All parts of the gift, including the issuance of any contribution certificates, are the exclusive responsibility of the appropriate charity organization.
Third parties, such as brands, advertisers, and sponsors, may use the Bingoor Platform or Bingoor to conduct banners, sample schemes, competitions, fliers, freebies, and other promotional campaigns as part of marketing, advertising, and visibility efforts. Despite anything to the contrary, you acknowledge that, to the greatest extent allowed by law, Bingoor will not be liable for such campaigns (including contests and contest prizes), which will be a bipartite agreement between you and the third parties, including with regard to the fulfillment of obligations as specified thereunder. In addition to being subject to the terms and conditions of the campaigns and the applicable third parties, participation in such campaigns, visiting any embedded third-party link, scanning codes, and/or using services in accordance with such campaigns are all at your own risk. Regarding such campaigns, Bingoor offers no express or implied representations or warranties of any type (including contest and contest rewards). The fulfillment of this obligation will be entirely the responsibility of the third parties.

Disclaimers

You understand and accept that the Bingoor Platform and the Services are offered "as is" and "as available" and that using them will be entirely at your own risk. Bingoor, its group companies, affiliates, and each of their directors, employees, officers, agents, and representatives (collectively, "Bingoor Parties") disclaim all express and implied warranties related to the Bingoor Platform, the Services, and your use of them, to the fullest extent permitted by applicable law. To the greatest extent allowed by applicable law, Bingoor disclaims all warranties and representations regarding the accuracy or completeness of the content on the Bingoor Platform and the Services and assumes no liability for any of the following: (i) errors, mistakes, or inaccuracies of content on the Bingoor Platform or the Services; (ii) personal injury or property damage, of any kind, resulting from your access to and use of the Bingoor Platform and the Services; (iii) unauthorized use of Bingoor servers and/or any personal information stored therein; (iv) any interruption or cessation of transmission to or from the Bingoor Platform; (v) any bugs, viruses, trojan horses, or the like that may be transmitted to or. (vi) any loss of your data or content from the Bingoor Platform and/or (vii) any mistakes or omissions in any material, as well as any loss or damage of any kind resulting from the use of any content that is posted, emailed, communicated, or otherwise made accessible over the Bingoor Platform. You are solely liable for any damage to your computer system or other device, as well as any loss of data resulting from the download of any material accessed through the use of the Bingoor Platform, and you do so at your own judgment and risk. Any transactions between you and third-party sellers or providers of goods or services will not be monitored by the Bingoor Parties, nor will they be involved in any manner. All conversations and interactions you have with other users of the Services and the Bingoor Platform, as well as with other people you interact or communicate with as a result of using the Services and the Bingoor Platform, are entirely your responsibility.

Unless otherwise specified in the conditions, no written or verbal advice or information you receive from Bingoor, the Services, or the Bingoor Platform will constitute a guarantee. You agree that when using the Services and the Bingoor Platform, you will not use any trade mark, service mark, trade name, or logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names, or logos, unless Bingoor has specifically authorized you to do so in writing.
Before engaging in any transactions, you acknowledge and promise to use your best and responsible judgment. Bingoor does its best to appropriately display the products that are available, including their color, size, shape, and look. The actual color, size, form, and appearance may differ from the representation on your computer, mobile device, or display screen since the same are representative.
Bingoor does not, to the greatest extent permitted by applicable law, make any representations or warranties regarding the goods or services (including digital goods) that are available on the Bingoor Platform, nor does it support or endorse the sale or purchase of any such goods or services on the Bingoor Platform, including with regard to availability, usability, redemption, or acceptance of such goods on any other platform. Bingoor disclaims any duty for third-party errors, inaccuracies, or omissions, as well as for information or inputs that are obtained from third parties and sent to you via the Bingoor Platform. To be clear, you will be subject to the terms and conditions of the third-party seller, issuer, or brand of goods (including digital goods like software, gift cards, or vouchers) in addition to these terms. Bingoor is not liable for any losses or delays resulting from out-of-stock or unavailable products, nor does it have any control over the merchantability and suitability of any product or service for a specific purpose. On behalf of any third party, Bingoor provides no covenants or promises.

Delivery Partners

Through independent contractors, often known as delivery partners, we enable principal-to-principal delivery of orders placed on the Bingoor Platform. For the avoidance of doubt, the delivery partners are neither agents nor employees of Bingoor, its affiliates, or Third Party Sellers. They are merely connected to Bingoor, its affiliates, and Third Party Sellers as independent service providers on a principal-to-principal basis and are not solely obligated by Bingoor, its affiliates, or Third Party Sellers to offer delivery services at any particular time. To be clear, there is no principal-agent relationship between Bingoor, its affiliates, or Third Party Sellers and the delivery partner. As a result, Bingoor, its affiliates, or Third Party Sellers cannot be held accountable for the delivery partner's actions or inactions.

In addition to enabling the provision of a safe and fearless gig/platform work environment for delivery partners, including the prevention and deterrent of harassment (including sexual harassment) against delivery partners, you are expected to respect the dignity and variety of delivery partners. If you act rudely, disrespectfully, abusively, or in any other way that might be considered improper or illegal when interacting with a delivery partner, we reserve the right to restrict your access to the Bingoor Platform. You must be kind and respectful to all of your delivery partners. Any repercussions resulting from your inappropriate behavior, including any claims or compensation demanded by a delivery partner, will be solely your responsibility.

Customer Comments, Reviews, Ratings

"Comments" will include (but is not limited to) reviews, comments, images, photos, audio, video, location data, nearby locations, and all other types of information, including any "Synthetically Generated Information" (which includes, among other things, any audio, video, or image that has been artificially created or altered to appear real) or data, your comments, content that you upload, share, or transmit in connection with the services, goods, or services, such as likes, ratings, messages, chat conversations, profile information, or any other materials that are publicly displayed in your account profile. Any comments that are shared, revealed, submitted, published, or offered on the Bingoor Platform, or that are otherwise disclosed, published, submitted, or offered in conjunction with using the Bingoor Platform/Services, belong to Bingoor and will continue to do so. You hereby irrevocably grant the Bingoor Parties an everlasting, irreversible, worldwide, non-exclusive, fully paid, and royalty-free license in exchange for using the Services on the Bingoor Platform and by submitting your Comments. The right to use, publish, and display the Comments and all associated intellectual property rights for any purpose, including marketing and advertising, is transferable, assignable, and sub-licensable. The term "use" refers to the following: use, copy, display, distribute, translate, reformat, publish, share, incorporate into advertisements and other works, analyze, promote, commercialize, create derivative works, and, in the case of third-party services, permit users and others to do the same. You give us permission to use the username or name you provide in relation to Comment(s). Any claims and assertions of moral rights or attribution regarding comments made against Bingoor, its customers, or any third-party services and their users are hereby irrevocably waived and caused to be renounced.

You must always make sure of the following when adding music, videos, photographs, or images to the comments section:
It should be concise, straightforward, and pertinent to the good or service you are reviewing and clicking on.
It should not include any promotional or prohibited content.
Bingoor will have the unrestricted right to use, reproduce, disclose, modify, and create derivative works from any Comments, as well as to publish, display, and distribute any Comments made for any reason. Bingoor has no responsibility to: (a) keep any comments private; (b) compensate for any comments or use of any comments; or (c) reply to any comments. You acknowledge that no third party's rights, including copyright, trademark, privacy, or any other personal or proprietary right, will be violated by any comments, and that no person or entity will be harmed.
You hereby attest that you will bear full responsibility for your comments and that they do not contain any proprietary, secret, private, or sensitive information about you or any third party. Additionally, you agree that no comments shall contain software infections, political campaigns, commercial solicitations, chain letters, mass mails, libelous or otherwise illegal, threatening, abusive, or obscene content. You consent to refrain from uploading or submitting any comments that come under the category of prohibited content. Bingoor maintains the right to keep an eye on, reject, and/or delete any comments made on the Bingoor platform. You hereby give Bingoor permission to use any names you provide in relation to any comments you make, with no obligation of secrecy. Bingoor will have full access to the Comments. You commit to refraining from using a fictitious email account, pretending to be someone or something else, and providing misleading information about the source of any comments you make. You undertake to indemnify the Bingoor Parties against all claims, losses, and liabilities arising from any Comments you submit, and you are and will continue to be liable for the content of any Comments you make.
You attest that you are the only author of your Comments, that you own or otherwise control all of their rights, or that you have received express permission from the rights holder to submit them; that your Comments are not copied from or based in whole or in part on any other content, work, or website; that your Comments are not submitted using any automated process, such as a script bot; that the use of your Comments by us, third-party services, and our and any third-party users will not violate or infringe upon any of your rights; that your Comments are accurate and truthful; and that your Comments do not violate any applicable laws. In addition to the aforementioned, if your comment or comments are reviews, they represent a real-life experience.
You hereby attest that you were not compensated in any way for writing or publishing the comment, and that you had no financial, competitive, or other personal motivation to write or publish a comment that did not fairly express your honest opinion.
Any reliance on the quality, accuracy, or dependability of your comment, as well as any exposure of personally identifiable information in your comment, are all risks that you bear. Although we reserve the right to remove comments, we have no control over the activities or reviews that our customers post, and we cannot guaranty the accuracy, integrity, or quality of any comments or content. You understand and accept that the customer or customers who made the comment or content are solely responsible for any and all liabilities resulting from it, not Bingoor.
Any Comment or material that we deem objectionable, in violation of the Terms, or otherwise detrimental to the Services or our Customers may be removed, blocked, or disabled at any time and without prior notice. We are under no obligation to return any of your comments or content to you, subject to the restrictions of relevant law.
Although we have the authority to remove comments, we have no control over your actions or comments, and we cannot guaranty their correctness, integrity, or quality. You understand and accept that any and all liabilities resulting from customer comments is the exclusive responsibility of the customer or customers who posted the information, not Bingoor.
Content from third parties, such as comments made by customers, does not represent Bingoor is viewpoint. We disclaim all liability and responsibility for any of your comments or content, as well as any content from third parties. You assume all risk and expense if you depend on comments from other users or third parties. Customers' opinions are reflected in the numerous evaluations or ratings that Bingoor receives for goods, services, and vendors. It is important to note that every review on Bingoor is solely the reviewer's or customer's own opinion. The reviews that these advertisers receive have no bearing on the ads that are published on the Bingoor Platform.
Since we are an impartial platform and do not mediate disputes between Third Party Sellers and reviewers, the best course of action for the Third Party Sellers representative would be to get in touch with the reviewer or publish a public response to address any misunderstandings if someone wrote a review that the Third Party Sellers do not believe to be accurate. The Third Party Sellers may notify us by email at Info@bingoor.com if they think that a certain customer's review violates any of Bingoor is policies. If the review violates the Terms or is otherwise detrimental to the Services, Bingoor may, at its sole discretion, remove it.

You Understand, Agree & Confirm

That all orders placed through your account, whether for delivery to your own address or someone else's, will require you to provide accurate delivery information, such as the recipient's name, address, contact information, etc., and to make the necessary payments. In this regard, Bingoor will not be liable or obligated to accept any claims for refunds or order cancelations.
that Bingoor will not be held accountable for any service or product delivery that is delayed or returned from its destination (including due to your incorrect name, address, or other inaccurate or deceptive information, the recipient's unavailability, or the recipient's refusal to accept the order at the time of delivery). You will be responsible for any expenses incurred by Bingoor in this regard.
Although Bingoor makes every effort to ensure that goods and services are delivered to you within the time frame indicated at the time of placing the order, Bingoor does not make any representations, guaranties, or warranties regarding the delivery time because the estimated delivery time may change without notice and there may be delays for reasons beyond Bingoor is reasonable control, such as the availability of third-party delivery service providers, demand, traffic and weather conditions, a force majeure event, the location provided by the customer or customers, the customer's building norms, delivery partner or service providers facing any on-the-ground difficulties (such as problems with their delivery vehicles, society granting them entry without hassles or delays, etc.
that the order will typically be delivered when someone is able to accept it at the address you have supplied. If you instruct the delivery partner to leave the goods at your door or give them to someone else, you will be completely liable for them. In these situations, you are not entitled to any money or reimbursement from Bingoor in the event that any goods or services are lost, damaged, or lacking. You specifically release Bingoor from any and all liabilities that might result from the order being neglected for a while. This covers, but is not restricted to, theft, tampering, contamination, and the outcome of any product temperature changes.
It is your sole responsibility and obligation to pay the cash amount for any cash-on-delivery orders placed through your account, whether they are for your own address or someone else's. You must also make sure that the payment is accurate, meaning that neither less nor more cash is paid to the delivery partners or service providers. Any disparity in this regard will not be our responsibility.
that when using, accessing, and conducting business on the Bingoor Platform, you will abide by all applicable laws and regulations and utilize the goods and services solely for legitimate reasons.

that before engaging in any transaction using the Bingoor Platform, you are using your best and prudent judgment and are doing so at your entire risk.
Delivery fees, handling fees, platform fees, small cart fees, high demand surge fees, rain surge fees, print fees, gift fees, and any other fees or charges that may occasionally be imposed (referred to as "Service Charges") may apply to transactions made through the Bingoor Platform. Before placing your order on the Bingoor Platform, you will be made aware of these service charges throughout the checkout process. You consent to paying this amount by placing the order. Service fees may differ from order to order depending on a number of variables, including order/cart value, distance, time of day, delivery demand, real-time traffic and weather analysis, seasonal peaks, and other variables that may be determined periodically. Additionally, Bingoor may occasionally provide its clients with credits, discounts, promo codes, vouchers, or any other type of cashback at its sole discretion. Such credits, discount codes, or vouchers may be changed, converted, canceled, or discontinued by Bingoor as it sees fit.

In accordance with current GST regulations and rates, prices shown on the platform for product combinations ("combos") include all applicable taxes. Unless otherwise specified, each item in a combination is regarded as a separate supply. For a thorough item-by-item breakdown that includes the values of each item, any relevant discounts, and taxes, please consult your tax invoice.

You may receive one or more separate invoices for each transaction on the Bingoor Platform for the sale of goods, the provision of services, and any applicable service charges that Bingoor may assign based on the value of the items in your cart; however, the total of all such service charges reflected under multiple invoices must not exceed the Service Charge as shown on the Bingoor Platform at the time of order placement.

If you have items in your basket that need to be picked up from many stores, they won't affect the service charges shown on the cart; instead, they will be applied to deliveries made from the closest store.

You understand and agree that the nature and form of the services that Bingoor offers may necessitate certain changes. As a result, Bingoor retains the right to suspend, cancel, or discontinue any or all of its products or services at any time without prior notice, as well as to modify and alter any or all of its contents, products, and services contained on the Bingoor Platform.
The ability to automatically check for software updates or upgrades may be included by us, the software, or the software application shop that makes the software available for download. You acknowledge that we, or the relevant software or software application store, may notify you of the availability of such upgrades or updates and periodically automatically push such an upgrade or update to your device or computer, unless your device, its settings, or computer software prohibits transmission or use of such upgrades or updates. To continue using or accessing the Services, or parts of them, you might need to install specific software upgrades or updates (including upgrades or updates intended to fix problems with the Services). Any upgrades or updates that we give you in accordance with the Terms will be regarded as a component of the Services.
We occasionally carry out research and experiments on many facets of the Services and offers, such as our apps, websites, user interface, and advertising campaigns, in an effort to continuously improve the Bingoor Platform and Services. Because of this, features may be experienced differently by some consumers than by others at any given time. This is to improve customer satisfaction, strengthen the safety and security of our services and offers, create new services and features, and make the Bingoor Platform better, more practical, and simple to use.
that, when asked, you will truthfully and accurately disclose if any content or comments you contribute are synthetically generated. It will be considered a serious violation of these terms if you make any false or deceptive statements.
Bingoor maintains the right to
attach a permanent label or audio disclosure to any content and/or comments that are confirmed to be synthetically generated information, as well as take technical steps to confirm the correctness of your claims;
remove content and/or comments right away, restrict access, and suspend or cancel your account without warning if there is a violation;
In situations where the complainant is a victim (or acting on behalf of a victim) of illegal Synthetically Generated Information made or disseminated by you, you must, as required by applicable law, reveal your identify and user details to the complainant.

Taxes on your Order

Documents such as order summaries and tax invoices, if required by the relevant legislation and standard business procedures, will be issued about the order you placed on the Bingoor Platform. The following parts and related paperwork may be included in your order:

Sale of goods: The necessary seller's tax invoice and bill of supply.
Service provision: A tax invoice issued by or on behalf of the appropriate service provider.
If the same person or entity provides both the products and the services ("Bundled Transaction"), (i) GST will be applied to the Bundled Transaction as a composite supply of goods and services, and (ii) the same person or company will issue the tax invoice and bill of supply.

The MRP that is shown on the platform matches what is listed on the product packaging. The government's amended GST rates, which went into effect on September 22, 2025, may affect the actual MRP and amount due.

You understand and agree that the GST terms and conditions (in addition to these Terms) and your submission of a valid GST number, as shown and required at the time of order placement on the Bingoor Platform, will determine your eligibility for any GST benefits with regard to eligible goods and services purchased through the Bingoor Platform. Not every product or service qualifies for a GST invoice. These GST terms and conditions are subject to change at any moment and will be considered incorporated into these Terms by reference.

Order Cancellation

You understand that (a) your cancellation, or attempted or putative cancellation of an order, or (b) cancellation for reasons not traceable to Bingoor, will constitute a violation of the Terms, and that any such request will be allowed only if Bingoor accepts it. We will initiate a refund, if any, against the relevant product or order for any permitted cancellations. This refund may take the form of promotional codes or coupons that can be used against a subsequent invoice for transactions on the Bingoor Platform, subject to any applicable terms, such as validity period.
Orders may be cancelled by Bingoor for any of the following reasons: (a) if it is suspected that a customer has engaged in fraudulent activity; (b) if it is suspected that a customer has engaged in a transaction that does not comply with or violates these Terms; (c) if the product or products are unavailable; or (d) for any reason beyond Bingoor's control, such as technical malfunctions or logistical issues related to delivery. Bingoor will conduct a refund, if any, against the relevant product or order for such cancellations within around 72 hours.
Additionally, Bingoor strives to guaranty that all goods and services provided for sale have accurate prices, specifications, and availability status. Even though Bingoor takes precautions to ensure accuracy, occasionally the specifications and prices may not be up to date or may be inaccurate due to technical difficulties, typographical errors, or inaccurate product/service information supplied to Bingoor by third-party sellers. In such a case, you will be informed as soon as Bingoor becomes aware of the error. Notwithstanding anything to the contrary, Bingoor retains the right in each of these situations to cancel the order and initiate a refund, if any, against the relevant order or product in the form of credit, cashback, coupons, or promotional codes for the value of the relevant product or order. These codes can be used against a subsequent invoice for transactions on the Bingoor Platform in accordance with any applicable terms, such as validity period.
Users who do not comply or who seem to be participating in fraudulent transactions may be denied access at any time, and their future orders may be canceled.

Returns & Refunds

Except in the following situations: (a) if the product is damaged, defective, expired at the time of delivery, or delivered incorrectly; and (b) if the return/refund/replace/exchange policy listed/displayed with respect to the relevant product/service expressly and specifically permits the same under specified circumstances; in that case, the return/refund/replace/exchange requests shall be processed in accordance with the terms of the relevant policy, including the specified timelines and conditions. Before placing an order and submitting a request for a return, exchange, or refund, please review the pertinent policies of each product or service that are offered on the Bingoor Platform. Before a remedy can be offered, you will need to submit evidence of the problem, such as pictures or videos. Refunds will not be accepted for goods or services that were unable to be supplied or performed for reasons that might be attributed to the customers or users, such as the customer's wrong location, the customer's lack of responsiveness when called, the user's building norms or social constraints, etc.

There is no return or refund policy for digital items (such as gift cards or vouchers), and you must contact the appropriate issuer or vendors if you have any concerns about their validity, usage limitations, or redemption. Please refer to the terms and conditions of the issuer or sellers that apply to you in addition to these terms for any such issues.
Subject to acceptable inspections, all reimbursements for authorised returns and cancellations will be completed within seven working days following the product's return or cancellation approval date.
Refunds for payments made via electronic means, such as debit card, credit card, net banking, UPI, etc., will be processed in the same way as they are received or given as a credit, cashback, coupon, or promotional code that can be used against a subsequent invoice for transactions on the Bingoor Platform, subject to any applicable terms, such as validity period, unless otherwise specified and/or mutually agreed upon by Bingoor and the customer. According to the policies of each bank, the refund amount will appear in your account as credits. using the exception that any refunds for goods paid for using cash on delivery will only be given in the form of promotional vouchers, which will expire 30 days after they are issued. Additionally, users can choose to receive a refund for online payments using a promotional code. Once the credit, cashback, discount, or promotional code is used, refunds cannot be converted back to any other payment method. Every other promotional code will expire seven days after it is issued.
Refunds will only be issued in Indian Rupees.

Bingoor Cashback

The term "cashback" refers to the granting of credit for the amount of qualifying cashback, which will be added to and reflected on the user's account. It does not, however, imply that the cashback will ever be reimbursed in cash or transferred to the user's bank or card account.
Either transactional or promotional cashback will be offered. Only as defined by Bingoor will a user be eligible for Cashback.
Orders that are canceled are not eligible for cashback. In such circumstances, Bingoor may recover any provided cashback without informing the user. Any cashback that is offered for orders for which a refund claim is made—whether in full or in part—will be adjusted to eliminate cashback that is related to the amount of the refunded order. This requirement will be strictly enforced regardless of whether cashback is displayed on any particular item or items listed on the Bingoor Platform as item-specific cashback.
Bingoor retains the right to withdraw, suspend, change, or cancel the Cashback offers and the terms that apply, at any time, without prior notice, and from time to time, without responsibility or prejudice to any of its other rights.
Any type of transactional or promotional cashback will appear in a user's Bingoor account in around 24 to 48 hours, while certain coupons may take up to 7 working days after the product is delivered. Unless Bingoor specifies a different time frame, the validity duration of transactional and promotional Cashback is 90 and 60 days, respectively, from the date of credit.
Bingoor does not in any way advocate, encourage, or recommend the buying of goods or engaging in transactions, among other things, that are eligible for Cashback.
Certain items and services may not be eligible for cashback and discount vouchers, as Bingoor may occasionally decide.

Payment’s Facility and Related Information

All orders and/or services must be paid for in Indian Rupees exclusively.

When paying for an order, information about the accepted payment methods on the Bingoor Platform will be shown. These methods may include, but are not limited to, credit card or debit card, net banking, UPI, cash on delivery, or any other RBI-approved payment method that may occasionally appear on the Bingoor Platform. For some orders, cash on delivery might not be accepted.
You understand and consent to Bingoor using specific third-party vendors and service providers, such as payment gateways, to handle credit card information and process payments. If you are referred to a third-party payment processor, you will be bound by the terms and conditions governing the use of that third party's service, and we will not be held responsible.
You represent, warrant, and covenant that you are legally allowed and/or authorised to supply and make payments using the payment information you have supplied in order to utilise the payment facility. You acknowledge that using these payment information does not violate any relevant laws and that you are entirely responsible for any payments made using them.
Bingoor's payment facility is not a banking or financial service; rather, it is only a facilitator that offers an automated online electronic payment system and accepts payments for orders placed on the Bingoor Platform using the authorised banking infrastructure and card payment gateway networks that are currently in place, if applicable.
You acknowledge and agree that the issuer may impose extra costs, such as transaction fees or other fees, on you in order to conduct your payment transaction for certain payment methods.

Order History

You will no longer be able to view or access your order data through your account if you remove an order from your purchase history on the Bingoor Platform. To be clear, if you place an order on someone else's behalf, your actions won't affect the order details' visibility since they are accessible through that person's account.

You are aware that your action will be irreversible and that no assistance will be provided regarding the deleted order or orders (whether they were placed for you or for someone else), including complaints, retrieval, information, or invoice requests, cancellation, refund, replacement, or exchange. Once erased, however, the order will still be in Bingoor's records in compliance with the Privacy Policy, our data retention rules, and any relevant laws, including those pertaining to statutory retention obligations. Please be aware that in situations outside of Bingoor's control, the deleted order or order data could be tracked down or made accessible for reasons like:
any disruptions, technical or service issues, or issues with using the internet, electronic communications, or other systems that are not under Bingoor's control.
Order data are still accessible on your or, in the case of orders placed on behalf of someone else, on that person's email, messaging, or other communication channels.
any stakeholder contacting you directly using the information you decide to provide with them, including delivery partners and other parties.
Payment for such an order can be found in bank statements.

Indemnity

You agree to indemnify, defend, and hold harmless the Bingoor Parties from and against any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) suffered or reasonably incurred by them as a result of, or in connection with: (a) Your Comment and/or content; (b) your unauthorized use of the Bingoor Platform/Services, or products or services included or advertized in the Services; (c) your access to and use of the Services; (d) your violation of another party's rights; or (e) your violation of these Terms (including the Privacy Policy and any infring your intellectual property rights of any third parties). Any and all claims or causes of action made against us may be settled, compromised, and paid without your prior approval. If you agree to assist us in defending these claims, we reserve the right, at your expense, to take over the exclusive defense and control of any matter for which you are obligated to indemnify us. Without our prior written consent, you agree not to settle any case in which we are listed as a defendant and/or for which you have indemnity responsibilities. When we become aware of any such claim, action, or proceeding, we shall make every attempt to tell you. When these terms expire or are terminated, this clause will remain in effect.

Limitation of Liability

Despite anything to the contrary:

Unless a court of competent jurisdiction issues a non-appealable order, Bingoor Parties shall not be liable for any claims, damages, or losses to the customer or any other person.
Subject to the aforementioned, the Bingoor Parties' maximum aggregate liability, if any, as determined and ordered, will never go beyond reimbursing the relevant user for purchases made in accordance with the relevant order that gave rise to and established the liability.
Under no circumstances, whether in a contract or a tort, will Bingoor be held accountable for any indirect, special, consequential, exceptional, punitive, or incidental losses or damages, including those resulting from lost revenue, reputational harm, or missed business prospects.
Any legal action you take against us must be started within a year of the alleged injury occurring. Regardless of any statute of limitations or other law to the contrary, failure to start the action within that time frame will permanently preclude any claims or causes of action pertaining to the same facts or occurrence. Any omission on our part to enforce or exercise any of these Terms' provisions or any associated rights during this time will not be interpreted as a waiver of that right or provision.

Termination

Bingoor retains the right, at its sole discretion and without liability, to cancel your registration, stop using the Bingoor Platform/Services, and/or refuse to allow or restrict your usage/access to the Bingoor Platform/Services, without notice, with or without cause, including if Bingoor has reason to believe (including by analyzing usage patterns), whether by notice or otherwise, that: (a) you do not meet the eligibility criteria, or that a user has violated the eligibility criteria, or (b) you may violate these Terms (including the Privacy Policy). Your account and all associated data may be instantly deactivated or deleted, and we may also prevent you from accessing the Services or your account in the future. We may, at our sole discretion, keep all information gathered from your usage of the Services if you violate these Terms. Additionally, you acknowledge that we will not be responsible to you or any other party if you stop using the Services.

By using the option on the Bingoor Platform/App and stopping further usage of the Bingoor Platform/Services, you can deactivate your account at any time. Your personal information will be handled in compliance with Bingoor is Privacy Policy, which is updated periodically.
Any termination of these Terms will not affect Bingoor is rights to any Comments, indemnity rights, or sections pertaining to Governing Law and Jurisdiction. Any such termination of these terms will not affect or waive your duty to pay for any goods or services that you have already ordered or obtained from the Bingoor Platform, nor will it impact any liability that may have developed or may develop in relation to events that occurred prior to the termination date.

Governing Law & Jurisdiction

Without taking into account the principles of conflict of laws, these terms shall be governed by and construed in conformity with Indian law.

Any proceedings pertaining to these Terms (including the Privacy Policy) will only be heard by courts in New Delhi.

Miscellaneous

Interpretation : These Terms' section and subject titles are provided solely for reference and should not be used to interpret any of its contents.

Entire Agreement and Waiver : The entire relationship between you and us about the Services will be comprised of the Terms and the Privacy Policy. No single or partial exercise of any right, power, or privilege by either party shall preclude any further exercise of that right or the exercise of any other right, power, or privilege under the Terms. Nor shall any failure or delay on our part to exercise any right, power, or privilege under the Terms operate as a waiver of such right or acceptance of any variation of the Terms.
Severability: If a court rules that any part of these terms is illegal, invalid, or unenforceable for any reason, that part will be considered severed from these terms, and the rest of the terms will remain in full force and effect.
Partnership or Agency: You will not be able to bind Us in any way, and none of the terms of these Terms will be interpreted as a partnership or agency between you and Us.

Third Party Ancillary Services

Bingoor/Third Party Sellers may work with third parties (such as brands, product manufacturers, platform sellers, vendors, and service providers) in order to improve customer/user experience or for other reasons as judged appropriate. You may be able to obtain specific services from these third parties, their employees, representatives, and service providers, or the pertinent services may be included in the product/services package itself. For example, installation services, services like demo services that are given to you as part of brand marketing and advertising efforts, etc.

You are aware that, in accordance with their terms and conditions and privacy policy, these third parties are the only ones offering the services. These services may be subject to additional fees. The terms and conditions and privacy policy of such third parties shall be supplemented by Bingoor is terms. Therefore, before choosing to use their services or buy the necessary goods, you should read their terms of service, which may be accessible on their website or platform.
Since these services are provided by third parties, Bingoor has no control over their quality, fulfillment, or completion. Examples of these services include customer service support and grievance procedures. Regarding these services, including dependability, quality, merchantability, appropriateness, and fitness for any specific purpose, Bingoor makes no representations and offers no guaranties or warranties. On behalf of any third party, Bingoor does not make any covenants. In compliance with the applicable guarantee/warranty terms, you must get in touch with the relevant brand/manufacturer immediately if you encounter any difficulties in this regard.
You expressly consent to Bingoor sharing your personal information, as available with Bingoor, along with order details with the third-party service provider in order to provide the services when you opt in for such services or place an order for a product that includes such services in the package (if applicable). After that, your personal data will be governed by both Bingoor is and the third-party service provider's privacy policies, as they may be updated.
The unavailability of third-party service providers, excessive demand, traffic jams, bad weather, users' building norms or difficulties with society granting them entry, lift accessibility, insufficient or inaccurate information and facts provided by the user, force majeure events, inaccurate location provided, unresponsive customers on the phone, additional details provided and/or change requested after order placement, or any other unforeseen event or circumstances could all have an impact on the services.

You understand and agree that using the third-party service provider's services is entirely at your own risk and that Bingoor will never be held accountable for any actions or inactions of the third-party service provider (including its employees, personnel, agents, contractors, professionals, and representatives).
